Terms and Conditions

1. Conclusion of a contract
By booking the applicant provides the operator, with a binding contract. The booking can be made in writing, orally or by telephone.  The contract is concluded with the confirmation of the organizer. The confirmation requires no specific form.

2. Payment
The invoice will be issued after the event.  Kiwi Connection may require a deposit in advance if additional expenses are expected. e. g. if materials need to be purchased before the event, these costs may be billed to the customer beforehand.

3. Services
What services are contracted, results from the description in referring to this information on the booking confirmation. The information contained in the offer and the price list is binding on the organizer.

4. Service and Price changes
Requirements or deviations of individual services from the agreed terms of the contract which are required by contract and were not caused by the Organizer are only permitted if the changes or modifications are not substantial and do not affect the overall form of the event.

5. Cancellation by the participant, transfer, substitute
The participant can withdraw at any time prior to the event from the event. The date of the cancellation is crucial for the calculation of the cancellation fee. We suggest declaring the cancellation in writing. If the participant withdraws from the contract or it does not participate in the event, the organizer may demand compensation for the arrangements and expenses.  The organizer can make this claim for compensation considering the following breakdown near the time of withdrawal to the start of the agreed event. In case of cancellation up to 8 weeks prior to the event, an administration fee of 10% deducted. In case of cancellation up to 35 days 25% and up to 2 days before the event we charge 50%. From then on and no shows 100% cancellation fee must be paid.
Until the beginning of the event, you can request that instead of you a third party enters into the rights and obligations of the contract. For external services the terms & conditions of the service provider are binding.

For changes we charge € 10, - to € 40, - for additional work.


6. Cancellation by the 0rganizer
Up to 8 days before the event, the organizer may withdraw from the contract if the specified minimum number of participants has not been reached.  After the start of the event, the organizer may terminate the contract without notice if the participant, despite warning, continues to disturb or breaches the contract. If the operator cancels, it retains the right to the event fee; however the participants must be credited the value of the expenses saved.

7. Liability of the organizer
The organizer is liable to provide to their best ability professional services as described in the booking contract. He is obliged to carry out the event so that it has the guaranteed properties and is not affected by errors which cancel or reduce the value or the suitability of the contract value. In particular, the organizer is responsible for: a) selection of the service providers and optimal performance b) a description of the services in the prospectus c) conscientious preparation of the event d) proper provision of the agreed services.

8. Limitation of Liability
Our liability for contractual claims for damages is limited with the exception of total body damage to the amount of three times the price of event, if the damage to the participant was either intentionally or with gross negligence by us. Our liability is also limited to a total of three times the price of event, if the occurrence of the damage was caused by the fault of the service provider. For all damage claims against the organizers of the participant in tort which are not based on intent or gross negligence, the available amount of liability shall be at least € 4,100. Our liability is excluded or limited if the legal requirements that are applicable to the performance of a carrier services to be provided, the liability is also excluded or limited. We are not liable for mediated external services if these were featured in the event description or in the booking confirmation as such or are obvious.

9. Obligations of the operator
The participant is required to participate in service disruptions that have occurred in the context of the legal provisions to avoid or minimize any damage. The participant has the obligation to immediately report complaints to the event manager. Any intentional failure of the participant to indicate the shortcomings will result in no reduction in price as written in the booking confirmation.

10. Exclusion of claims and limitation
Any claims arising from the contract must be made within one month of the contractual end of the event by the organizers and have a limitation period of six months after the contractual end of the event.

11. Cancellation of the contract due to exceptional circumstances
If the event is, as a result of force of nature (e.g. war, civil unrest, natural disasters, ) significantly impeded, endangered or impaired it is the right of both the organizers and the participants  to terminate the contract.

12. Regulations
The participant is responsible for compliance with all regulations for the conduct of the event itself. All the consequences arising from the non-observance of these regulations are to be borne by the participant, unless caused by a culpable wrong or misinformation from the organizer.

13. Other, Special Risks
The events offered have adventure, sport and / or experiential character. In view of these risks occurs participation AT YOUR OWN RISK. This applies in particular to risks that are not predictable by the organizer. A liability for damages of any kind related to the character of such an event does not exist. This does not affect obligation to carefully prepare for the events. Requirement for participation is a healthy physical condition and the ability to be able to swim (for water events). For the safety of the participants the project leader reserves the right to change the program if necessary, due to unforeseen circumstances and weather conditions. During the event -for their own safety and the safety of others- the participants should follow the instructions of the project leader. If a participant does not follow the instructions, the organizer is entitled to immediate termination of the contract. The organizer reserves the right to charge the participants respectively; however a reduction may be made due to expenses saved.

The same applies with a drunken participant (0.5 alcohol limit!)

14. Performance and fulfillment, General
The place of performance and fulfillment is the registered office of the organizer. The ineffectiveness of single regulations does not invalidate the entire contract.
